Acceptance of terms

By accessing or using joshiestates.com, submitting a form, or otherwise interacting with Joshi Estates LLC(“Joshi Estates,” “we,” “us”), you agree to these Terms of Service. If you do not agree, do not use the site.

Service description

Joshi Estatesprovides real estate investment consulting. We offer general guidance and practical insight on investment strategies — fix-and-flip, rental, and development opportunities — including potential risks, returns, and timelines. We are not a licensed real estate broker, not a lender, not an investment adviser, and not your agent or fiduciary. Our consultations are informational and educational and do not constitute financial, investment, legal, tax, or appraisal advice. You are responsible for your own investment decisions and should consult appropriately licensed professionals before acting.

Eligibility

You represent that you are at least 18 years old and that any information you submit about yourself or a property you are considering is accurate to the best of your knowledge.

No warranty

The site and our services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee any particular investment outcome, return, valuation, or timeline. Real estate investing carries risk, and any decision you make based on our guidance is made at your own discretion and risk.

Limitation of liability

To the maximum extent permitted by law, Joshi Estates LLC and its members, officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the site or our services. Our aggregate liability for any claim arising out of or related to these Terms or the site will not exceed the greater of one hundred U.S. dollars ($100) or the total fees you paid to us in the twelve (12) months preceding the event giving rise to the claim. Where you have paid us no fees, the cap is $100.

Indemnification

You agree to indemnify, defend, and hold harmless Joshi Estates LLCfrom and against any claims, damages, losses, and reasonable attorneys’ fees arising out of or related to (a) your breach of these Terms, (b) any inaccurate information you provide to us, or (c) your violation of any applicable law in connection with an investment decision or transaction you pursue.

Governing law

These Terms are governed by the laws of the State of IA, excluding its conflict-of-laws principles. Any non-arbitrable dispute will be brought exclusively in the state or federal courts located in IA.

Dispute resolution

Before filing a claim, the parties will attempt in good faith to resolve the dispute informally for at least thirty (30) days after written notice. If unresolved, the dispute will be settled by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, seated in a county of the State of IA. Judgment on the award may be entered in any court of competent jurisdiction. Class actions, class arbitrations, and representative actions are waived.

30-day right to opt out of arbitration. You may opt out of this arbitration agreement by emailing business@joshiestates.com within thirty (30) days of first accepting these Terms with the subject line “Arbitration Opt-Out” and your full legal name. Opting out will not affect any other provision of these Terms.

Severability

If any provision of these Terms is held invalid or unenforceable, that provision will be severed and the remaining provisions will remain in full force and effect.

Changes to these terms

We may update these Terms from time to time. When we do, we will move the “Last updated” date above. Your continued use of the site after a change takes effect constitutes your acceptance of the revised Terms.

Privacy

Your use of the site is also governed by our Privacy Policy, which explains what we collect and how we use it.
